Terms of Service

Last updated: 1 January 2025

These Terms of Service ('Terms') govern your use of the Sky-Back platform and services. By using Sky-Back, you agree to these Terms. Please read them carefully.

1. Our Service

Sky-Back provides a claims management service that pursues flight compensation on your behalf under applicable passenger rights regulations, including EU EC 261/2004, UK UK261, Canada APPR, US DOT rules, and other equivalent legislation. We act as your authorised representative in correspondence with airlines and, where necessary, in legal proceedings.

2. Eligibility

You must be at least 18 years old to use our service. You confirm that the information you provide is accurate and complete, and that you are the named passenger or have authority to act on behalf of all passengers included in the claim.

3. Our Fee

Our standard fee is 10% (tax included) of the compensation recovered. If legal action is required, an additional 20% applies (total 30%). No fee is payable if we are unsuccessful. By submitting a claim you authorise us to deduct our fee before transferring the remaining compensation to you.

4. Assignment of Claim

To pursue your claim effectively, you assign us the right to act as your legal representative. You may not separately pursue the same claim through another service or directly with the airline while we are acting for you.

5. Your Obligations

You agree to provide accurate information; respond to our requests promptly; not to accept any settlement from the airline directly without notifying us; and to inform us of any changes relevant to your claim.

6. Cancellation

You may withdraw from our service within 14 days of submitting a claim at no cost. After 14 days, if significant work has been undertaken, a reasonable withdrawal fee may apply.

7. Limitation of Liability

We do not guarantee a successful outcome. Our liability is limited to the fees paid to us. We are not liable for indirect, consequential, or special damages.

8. Governing Law

These Terms are governed by the laws of the Republic of Ireland. Any disputes shall be subject to the exclusive jurisdiction of the Irish courts.

9. Changes

We may update these Terms. Continued use of our service after changes constitutes acceptance of the revised Terms.
